Marilyn Mosby Files to Stay Forfeiture of Florida Condo Pending Appeal

Marilyn Mosby, the former Baltimore State’s Attorney, has filed a motion to stay the forfeiture of her Florida condo pending an appeal of her mortgage fraud conviction, according to recent court documents.

In February 2024, Mosby was found guilty on one count of mortgage fraud related to a false gift letter used in the purchase of a condominium in Long Boat Key, Florida. On May 23rd, Judge Lydia Griggsby ordered the forfeiture of the condo, which Mosby bought in February 2021 for $476,000.

Federal prosecutors had argued that Mosby should be required to give up the property following her conviction. However, prior to the hearing, they indicated that Mosby would be entitled to receive her $47,600 down payment back, as well as 10% of the appreciated value if the condo is sold for a profit.

In court filings, Mosby’s legal team contends that the property was purchased in an effort to secure financial independence amid a crumbling marriage. They argue that without the ability to rent out the condo, Mosby’s income streams would be inadequate. The defense team further notes that the condo’s value has significantly appreciated since the original purchase, with Redfin estimating its current worth at $886,084 and Zillow valuing it at $781,800.

Mosby has now filed a motion to stay the forfeiture order pending the outcome of her appeal, seeking to retain possession of the Florida property during the legal process.
