Napolitano to Newsmax: Don’t Extend Trump Gag Order

Former President Donald Trump should not be issued a gag order from commenting on the daughter of the judge presiding over his hush money case, retired New Jersey Superior Court Judge Andrew Napolitano told Newsmax on Monday.

Napolitano explained to Newsmax’s “Newsline” that the daughter of Judge Juan Merchan “is a major Democratic fundraiser who is raising money for Democratic candidates based upon Donald Trump as a defendant in this case.”

Napolitano pointed out that Merchan initially did issue a gag order silencing Trump from making public comments on the prosecutors and witnesses in the case, but did not include himself or his daughter, which “was the right thing.”

Napolitano added that “in my world, there would be no such thing as a gag order, saying that he “never issued a gag order. I believe in general that a gag order is unconstitutional, particularly when the defendant is a public figure and people are taking shots at him from all corners. He has the right to say whatever he wants.”

But, in any case, after Merchan’s first gag order in the case, Trump attacked the judges’ daughter, and the prosecutor “wants to silence Donald Trump from criticizing the judge’s daughter.”

Napolitano asked, rhetorically, “does the judge gain by what his daughter did. No. Does the daughter gain by the judge trying the case. No.

“Is the daughter fair game for what Donald Trump wants to say. She should be, Napolitano said, emphasizing that the judge should not extend the gag order to the daughter, because “the daughter is taking shots at Donald Trump through her clients. He has the right to resist and reject that.”
