Baltimore man sentenced to over 10 years for gun, ammunition possession as felon

A Baltimore man with multiple prior felony convictions has been sentenced to more than 10 years in federal prison after he was found in possession of a firearm and ammunition, according to the U.S. Attorney’s Office for the District of Maryland.

U.S. Chief District Judge George L. Russell sentenced David Funderburk, 47, to 125 months in prison, followed by three years of supervised release, after a federal jury convicted him of possession of a firearm and ammunition by a convicted felon. The conviction was Funderburk’s fourth federal felony conviction and came in September 2025.

According to authorities, on Nov. 3, 2023, Baltimore Police Department Southwest District Action Team detectives were conducting routine patrols in the 1500 block of W. Baltimore Street when they observed Funderburk “exhibiting characteristics of an armed person.” Police said he entered a local eatery, and detectives watched him through the front window as he bent down around a corner, pulled a firearm out of his pocket — an FN Five-seven 5.7x28mm handgun — and placed it on the floor in the corner of the restaurant.

Detectives then entered the eatery and detained Funderburk, authorities said. Police also recovered the firearm from the corner of the restaurant, and it was loaded with 18 rounds of 5.7x28mm ammunition.

Because of his prior felony convictions, authorities said, Funderburk was prohibited from possessing firearms and ammunition.

The sentence was announced by Kelly O. Hayes, U.S. attorney for the District of Maryland, along with ATF Special Agent in Charge Charles Doerrer and Baltimore Police Commissioner Richard Worley.
