From tariffs to transgender sports bans: Attorney weighs on Supreme Court decisions

The Supreme Court is currently deliberating on significant cases from Idaho and West Virginia that challenge transgender participation in women’s sports.

Former U.S. attorney John Fishwick told The National News Desk that conservative justices, including Justice Kavanaugh, seem inclined to uphold bans preventing transgender girls and women from participating in girls’ or women’s sports.

Fishwick said, “They really seem to be saying in a number of these cases that they’re going to leave it up to the states to decide that.” A final decision may take months.

In another case, the Supreme Court is also considering the legality of tariffs imposed by former President Donald Trump under emergency powers. Fishwick suggested that the court might strike down these tariffs, as Trump needs to prevail on several legal issues, including the appropriate delegation of power by Congress under a 1977 law. Fishwick said, “If I have to read the tea leaves here, I think the Supreme Court is going to strike down the tariffs.”

Additionally, Trump announced plans to cut off payments to sanctuary cities starting in February due to their immigration policies. He intends to appeal previous court decisions that blocked this action, aiming to bring the case before the Supreme Court. Fishwick commented on Trump’s strategy, saying, “I expect to lose some of these early court decisions and that the judges will say, I can’t do that.”
